What “green building compliance” actually means in Texas

Most Texas commercial projects never register with the U.S. Green Building Council. What they do encounter is a local green-building or energy requirement attached to the permit — and those requirements vary sharply between cities. A Dallas first-time finish-out, a Houston tenant improvement and an Austin retail build face three different rulebooks, three different review paths and three different sets of documents from the engineer.

There is also a gap most design teams miss. The State Energy Conservation Office still uses the 2015 IECC as the statewide baseline for commercial construction, after a legal interpretation stalled its move to the 2021 edition. Meanwhile Houston, Dallas, Austin and San Antonio have all moved to the 2021 standards locally. If your consultant designs to the state baseline in one of those cities, the set is behind the adopted code before it is submitted. Confirm the adopted edition against the jurisdiction’s own ordinance — not the state default.

Which LEED credits an MEP engineer actually controls

On a LEED project the design team splits the scorecard. The MEP engineer owns a specific, substantial slice of it:

  • Energy & Atmosphere (EA). Fundamental commissioning support, minimum energy performance, and optimized energy performance — the credits driven by the whole-building energy model and the HVAC and lighting systems behind it. This is the heaviest MEP-controlled category.
  • Water Efficiency (WE). Indoor water use reduction through fixture selection and flow rates, plus process water and any reclaimed or condensate reuse the plumbing design supports.
  • Indoor Environmental Quality (EQ). Minimum indoor air quality performance and enhanced ventilation under ASHRAE 62.1, thermal comfort, interior lighting quality and controllability, and acoustic performance of mechanical systems.

Site, materials and regional credits belong to the architect, civil engineer and contractor. The point of naming the split plainly is that it tells you exactly what to hold your MEP engineer accountable for — and what you still need someone else for.

Energy modeling and ASHRAE 90.1

Nearly every green-building path in Texas resolves at some point to an energy calculation. That takes one of two forms. Prescriptive compliance — COMcheck against IECC or ASHRAE 90.1 — is the common route on tenant finish-outs and smaller commercial work, and it is a document your MEP engineer signs and seals. Performance compliance — a whole-building energy model with an ASHRAE 90.1 Appendix G baseline, comparing proposed annual energy use against a minimally code-compliant building — is what LEED’s optimized-energy-performance credits and some local programs require.

We produce load calculations and sealed COMcheck energy compliance as standard scope. Whole-building performance modeling is scoped per project. If your project needs a full Appendix G model, ask for it explicitly when you request a proposal so it is priced in rather than assumed out.

Houston — the misconception is the story

Houston’s LEED policy applies to city-owned buildings, not private development. The real compliance driver on a private Houston job is the adopted energy code plus Houston’s unusual code family — the city enforces the Uniform Mechanical and Plumbing Codes and NEC 2023 rather than the International codes most out-of-town sets assume.

Dallas — certifiable, not certified

Dallas Chapter 61 lets a commercial project comply by being LEED certifiable — designed and documented to the standard without registering with USGBC. It also has a scope rule that decides whether your project is in or out entirely, and it catches landlords doing finish-outs.

Austin — the deadline starts at schematic design

Where an Austin Energy Green Building rating is required, the project application is due within schematic design, AEGB runs inspections separate from the City’s, and Final Approval gates your Certificate of Occupancy.

Where we fit, and where we do not

Good fit: you need a sealed MEP set for a Texas commercial project that carries a green-building or energy-compliance requirement — restaurant, retail, medical or dental, office or warehouse tenant improvement, mixed-use, or a public project with supplier-diversity requirements. You want the engineer who draws the systems to also produce the energy compliance and answer the reviewer.

Not a fit: you need someone to register the project with USGBC, run credit tracking across the whole team, and manage the GBCI submission and review responses. That is LEED AP work. Pyra does not hold a LEED credential and does not present itself as a certification consultant. We collaborate with LEED APs and accredited raters and are happy to work under one — but if a firm offers you the engineering and the certification administration as a single seamless package, ask which registry they appear in before you sign.

Frequently asked questions

Can an engineering firm be LEED certified?

No. The U.S. Green Building Council is explicit that LEED certifies buildings, spaces, neighborhoods, homes, cities and communities — not products, services or companies. Individuals earn LEED accreditation as a LEED Green Associate or LEED AP; buildings earn certification. A firm advertising itself as “LEED certified” is describing something that does not exist.

Can my MEP engineer do LEED, or do I need a separate LEED consultant?

Both, usually. The MEP engineer designs the systems that earn the energy, water and indoor-air-quality credits and produces the energy compliance documentation — that is the largest single block of credits on most scorecards. A LEED AP registers the project, tracks the full scorecard across all disciplines and manages the GBCI submission. On smaller projects pursuing a local green-building path rather than formal LEED certification, you may need only the engineer.

Which LEED credits does the MEP engineer control?

Primarily Energy & Atmosphere, Water Efficiency, and Indoor Environmental Quality — the energy model and HVAC and lighting systems, plumbing fixture water use, and ventilation, thermal comfort and lighting quality. Site, materials and construction-waste credits sit with other members of the team.

Who does the energy model for a LEED project?

The MEP engineer or a dedicated energy modeler, depending on scope. Prescriptive COMcheck compliance against IECC or ASHRAE 90.1 is normally the MEP engineer’s deliverable and is sealed. A full whole-building performance model to ASHRAE 90.1 Appendix G is a separate scope that should be priced explicitly.

Does Texas require green building certification?

There is no statewide green-building certification mandate for private commercial construction. Requirements are local — Dallas through Chapter 61, Austin through Austin Energy Green Building on certain developments, and individual cities through their adopted energy codes. Houston’s LEED policy applies to city-owned buildings. Always confirm against the jurisdiction that will issue your permit.

What is the difference between the state energy code and my city’s?

The State Energy Conservation Office continues to use the 2015 IECC as the statewide commercial baseline. Houston, Dallas, Austin and San Antonio have adopted the 2021 standards locally. Cities may amend, but amendments may not be less stringent in non-attainment and affected counties. Design to the adopted local edition.

Do you provide LEED design support?

Yes — as the MEP engineer of record. That means designing systems to hit the targeted energy, water and indoor-air-quality credits, producing sealed energy compliance documentation, and supplying the mechanical, electrical and plumbing information the certification or rating submission needs. It does not include registering the project or administering the GBCI submission.

Do I need a P.E.-stamped set for a green-building project in Texas?

For commercial work of meaningful size, yes — and the green-building path does not change that. See whether your Texas tenant finish-out needs a sealed MEP set. Requirements vary by jurisdiction and scope; confirm with your AHJ.
